CSL prepares case to battle FTC on Talecris acquisition

Brian McNamee, CEO and managign director of CSL, has legal advisors preparing the company’s appeal against the decision by the US regulatory authorities to block CSL’s $3.1 billion acquisition of Talecris Biotherapeutics.
“McNamee will play to win, there’s no doubt about it,” said analyst Stuart Roberts of Southern Cross Equities. “He would be well advised by his legal team. It would be very unlikely that McNamee would choose to go down this road and take on the US Federal Trade Commission unless he intends to win the appeal.”
Other analysts are not so sure.
David Low of Deutsche was more circumspect about McNamee’s gung-ho approach. “We see limited near-term upside given the uncertainty that the decision to challenge the FTC has caused,” Low said.
